Airbnb clearly was on weak ground against HomeAway in this trademark lawsuit, and apparently withdrew the campaign. The gloves are off, however, and the two rivals can expect to see their competition against one another get nastier in coming years.

This lawsuit marks the fact that for HomeAway, Airbnb has now crossed a line -- into HomeAway's core resort destination markets. Gone is all the talk about the two companies addressing different markets. The two companies will now play, old-fashioned country hardball.

Under the partnership, Orbitz passed customers' credit card information to Trilegiant without notifying consumers. Orbitz terminated the practice starting in 2008, but a judge says Orbitz still has to make the payments that the contract called for.

Airbnb's current stance would likely be much different if its path to an IPO was uncluttered by web of local and state laws that could trip it up.

The subpoena will likely be pared down before it is issued. Some big issues will be coming to a head in this probe, including whether an apartment rental by an individual renders the apartment a hotel that is subject to occupancy tax.

Warren's case is not representative of most Airbnb stays in New York City where people are known to run illegal hotels and entire apartments are one of the most common kind of rentals.

Forcing plaintiffs to individually arbitrate their claims of hotel-price-fixing against Travelocity would sabotage the class-action lawsuit if the ruling stands up. There undoubtedly will be further developments in this case.

This discrimination lawsuit against United is not necessarily over with this dismissal. The judge granted the pilots the right to amend their complaint and to refile it.

Getting ousted from a high-profile property is a black eye for any company, but this is the second time this year that owners didn't think Marriott was living up to the terms of its agreement.
