Case Closed as HomeAway and Airbnb Officially Settle Lawsuit

A U.S. District Court Judge in Austin, Texas issued a final judgment in HomeAway Inc. V. Airbnb Inc., declaring the case “closed,” as of January 3.

A day earlier, plaintiff HomeAway filed a notice of dismissal, noting that the parties have settled the case “with each party to bear its own costs and attorneys’ fees.”

No other details of the settlement were publicized, although Airbnb nixed its first national advertising campaign, a $2 million effort,  and clearly backed down.

HomeAway had sued Airbnb December 23, alleging misappropriation of HomeAway’s birdhouse trademark.

There’s been no word from Airbnb yet on how it plans to proceed on the advertising front now that its maiden effort has been scratched.
